These Terms of Service (“Terms”) govern your access to and use of BeyondNow’s websites, apps, products, and services (collectively, the “Service”). By creating an account, using the Service, or clicking “accept,” you agree to these Terms.

If you do not agree, do not use the Service.


1) Who we are and what we provide

BeyondNow helps you capture and preserve stories, voice, media, and personal reflections in a private digital vault, with optional sharing and legacy features that allow you to designate who may access content you choose to share.


2) Eligibility

You must be at least 13 years old (or the minimum age required in your region) to use the Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.


3) Your account

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Providing accurate account information and keeping it up to date

You must notify us promptly if you believe your account has been compromised.


4) Your content and permissions

A. Your ownership

You retain ownership of all content you upload, record, or submit to BeyondNow (“User Content”), including video, audio, photos, text, documents, and metadata.

B. License you grant to BeyondNow

To operate the Service, you grant BeyondNow a limited, non-exclusive, worldwide license to host, store, process, reproduce, and display your User Content only to:

  • Provide and maintain the Service and its features
  • Perform backups and prevent loss
  • Enforce your sharing settings and access controls
  • Improve reliability, security, and performance

This license ends when you delete your User Content or close your account, except to the extent we must retain certain data for legal, security, or operational reasons, or as described under a purchased Preservation Plan.

C. Sharing and designated access

You control what you share and with whom. If you grant access to another person (e.g., a family member), they may view, copy, or download what you make available to them. You are responsible for ensuring you have the rights to share any content you share through BeyondNow.


5) AI and processing features

Some features may include transcription, search, summaries, organization, or other automated processing (“AI Features”). When you enable or use AI Features, you authorize BeyondNow to process your User Content as needed to provide those outputs.

We do not sell your User Content. Your vault is private by default, and we do not provide advertisers access to your private vault. (For more details, see our Privacy Policy.)


6) Acceptable use

You agree not to misuse the Service. You may not:

  • Upload content that you do not have the right to use or share
  • Violate any law or regulation
  • Attempt to access another user’s account or private content
  • Interfere with or disrupt the Service (including hacking, malware, scraping, or abuse)
  • Use the Service to harass, threaten, or exploit others
  • Reverse engineer or attempt to extract source code (except where permitted by law)

We may suspend or terminate accounts that violate these Terms.


7) Subscriptions, fees, and billing

If you purchase a membership, add-on, or service:

  • Prices, plan details, and billing intervals will be shown at checkout
  • Subscriptions generally renew automatically unless you cancel
  • Taxes may apply depending on your location
  • Payment processing is handled by third-party providers; we do not store full payment card details

No refunds are provided unless required by law or stated otherwise at purchase.


8) Storage limits and plan changes

Plans may include storage or usage limits. If you exceed plan limits, we may:

  • Require an upgrade to continue uploading
  • Restrict additional uploads until you reduce usage
  • Offer other remedies described in-product

You can change plans subject to the terms shown at the time of change.


9) Legacy Preservation Plans and guided services

A. Preservation Plans

If you purchase a Preservation Plan (a one-time purchase):

  • It may include longer retention and maintenance commitments as described at purchase
  • It may include format migration and continuity measures as technology evolves
  • Specific details and obligations will be governed by the Preservation Plan Addendum below and any disclosures presented at checkout

B. Guided experiences (Concierge / Capture)

If you purchase guided services (e.g., dedicated representative, recording sessions, in-person sessions):

  • Scheduling, scope, and availability may vary
  • In-person services may involve additional fees (travel, time, logistics), disclosed before confirmation
  • We may use trusted contractors to deliver parts of the service under confidentiality obligations

10) Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if:

  • You violate these Terms
  • Your use creates risk or legal exposure for BeyondNow or others
  • We are required to do so by law

Upon termination, your access to the Service ends. Deletion and retention are handled as described in our Privacy Policy and any purchased Preservation Plan terms.


11) Intellectual property

BeyondNow and its licensors own all rights in the Service, including software, design, and branding, except for your User Content. You may not use our trademarks without written permission.


12) Third-party services and links

The Service may integrate with or link to third-party tools (e.g., payment processors, hosting, analytics). We are not responsible for third-party services and their terms.


13) Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, BeyondNow disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the Service will be uninterrupted, error-free, or that all content will always be recoverable.


14) Limitation of liability

To the maximum extent permitted by law, BeyondNow will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

BeyondNow’s total liability for any claim relating to the Service will not exceed the amount you paid to BeyondNow for the Service in the 12 months before the event giving rise to the claim (or $100 if you have not paid us), unless applicable law requires otherwise.


15) Indemnification

You agree to indemnify and hold BeyondNow harmless from claims, damages, and expenses (including reasonable legal fees) arising from:

  • Your User Content
  • Your use of the Service
  • Your violation of these Terms or applicable law

16) Copyright and takedowns (DMCA)

If you believe content on the Service infringes your copyright, contact us with:

  • Your contact information
  • A description of the copyrighted work
  • The location of the allegedly infringing content
  • A statement of good faith belief
  • A statement under penalty of perjury that the information is accurate

17) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide additional notice (e.g., email or in-product notice). Continued use after changes means you accept the updated Terms.


18) Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought in the courts located in Ontario, Canada, and you consent to their jurisdiction and venue.

Preservation Plan Addendum (BeyondNow)

Effective date: June 1, 2025
This Preservation Plan Addendum (“Addendum”) supplements the BeyondNow Terms of Service and applies if you purchase a Legacy Preservation Plan (“Preservation Plan”). If there is a conflict between this Addendum and the Terms, this Addendum controls only for Preservation Plans.

1) What a Preservation Plan is

A Preservation Plan is a one-time purchase that extends BeyondNow’s commitment to preserve and maintain your vault for the term you select (25, 50, 75, or 100 years), subject to this Addendum and applicable law.

2) When it starts

Your Preservation Plan term begins on the date your purchase is confirmed (the “Plan Start Date”), unless otherwise stated at checkout.

3) What’s included

During the selected term, BeyondNow will make reasonable efforts to:

  • Maintain your vault in secure archival storage with redundancy
  • Preserve access continuity for designated recipients based on your settings/instructions
  • Perform reasonable format migration or compatibility updates as technology evolves, so preserved materials remain usable
  • Maintain administrative continuity needed to support the Preservation Plan

4) What’s not guaranteed

Because technology and platforms change, you understand and agree:

  • We do not guarantee any specific future feature, device, or platform will exist or support your content
  • “Digital presence,” “avatar readiness,” or similar future-facing language refers to preserving usable source materials and structured data that may support future experiences, not a promise of any particular outcome

5) Your instructions and designated access

Preservation depends on your configuration:

  • You are responsible for keeping your legacy instructions and designated access contacts accurate
  • If you do not designate recipients or provide instructions, BeyondNow may be unable to grant access, even if the archive is preserved

6) Content scope and plan limits

Your Preservation Plan covers the vault contents associated with your account, subject to any plan limits disclosed at purchase (including storage capacity, if applicable). If your vault exceeds the covered limits, we may require adjustments, an upgrade, or additional fees to continue preservation.

7) One-time purchase, refunds, and transfers

  • Preservation Plans are one-time purchases and are generally non-refundable, except as required by law or explicitly stated at checkout
  • Preservation Plans are tied to the account and vault they were purchased for and are not transferable except as required by law or approved by BeyondNow in writing

8) Term expiration

At the end of the selected term, BeyondNow’s Preservation Plan obligations end unless you (or an authorized representative) renews or extends preservation under terms available at that time.

9) Suspension/termination for misuse

If an account is used to violate the Terms (e.g., unlawful content or abuse), BeyondNow may suspend access or terminate services as required to comply with law or protect safety. Preservation commitments may be limited where legally necessary.
